Terms of Service

1. About Tale Guru

Tale Guru operates at https://tale.guru and provides paid writing consultations and bespoke writing services, including short stories, novels and website articles.

The service provider is Yury Nikiforov, an individual entrepreneur registered in Cyprus, SIC: 1582083.

Address: 28 Oktovriou 279, 3035 Limassol, Cyprus
Email: contact@tale.guru
Telephone: +357 999 12134

In these Terms, “we”, “us” and “our” refer to Yury Nikiforov trading as Tale Guru. “You” refers to the individual purchasing our services.

2. Eligibility and scope

Our services are available to individuals aged 18 or over purchasing in their personal capacity.

We accept international enquiries, subject to applicable law. You must provide accurate contact information and have the right to share any materials you supply.

These Terms govern consultations purchased through our website and writing services agreed by email. Project-specific details agreed in writing form part of your contract. They take priority over these Terms only where they expressly address the same issue and do not reduce your mandatory consumer rights.

3. Consultation orders

Submitting the website form creates a consultation order request. The consultation contract becomes binding once payment is successfully received.

The consultation price is displayed before payment in US dollars (USD) and includes all applicable taxes. Your payment provider may apply its own currency conversion or banking charges.

The consultation includes:

  • A two-hour consultation call.
  • A written report delivered by email.

We will arrange the call with you by email and provide both the call and the report within two months after payment. Please respond promptly to scheduling requests and provide the information reasonably needed for the consultation.

Purchasing a consultation does not commit you to purchasing writing services. Writing services are quoted and charged separately.

4. Scheduling and missed consultations

You may reschedule your consultation once without an additional consultation fee by contacting us before the scheduled start time. We will confirm the replacement appointment by email.

If you request a second rescheduling or fail to attend a confirmed appointment without arranging a change beforehand, we may close the booking without providing another appointment.

Closing a booking does not override your refund rights under Section 8 or your statutory rights. A missed appointment does not, by itself, mean that the service has been fully performed for the purpose of ending a statutory right of withdrawal.

If we need to change an appointment, that change does not count as your permitted rescheduling. If we cannot provide the consultation and report within the promised period, you may agree to a revised deadline or cancel for a full refund.

5. Writing services

After the consultation, we may offer a separate writing project. The scope, price, payment arrangements, deadlines, deliverable format, included revisions and any other project-specific requirements will be agreed by email before work begins.

Writing services are paid separately against an invoice, rather than through the website checkout. We begin work once the project details have been agreed in writing and the agreed payment required to start has been received, subject to Section 9.

Changes to the agreed scope, fees or deadlines require written agreement. Additional work is not automatically included in the original price.

You must provide the materials, instructions and feedback reasonably needed to complete the project. If a delay on your side affects delivery, we will explain the impact and agree any revised timetable by email.

6. Delivery and acceptance

We deliver writing work by email or through a delivery method agreed by email.

You may expressly accept the final work by email. If you do not respond within three months after we email the final deliverable, the work will be treated as accepted at the end of that period.

If you raise an issue or request revisions within that period, we will address it according to the agreed project scope. The automatic acceptance rule applies only where you have not responded.

Acceptance does not remove your refund rights under Section 8 or any rights concerning defective or non-conforming services under applicable law.

7. Your materials and permitted projects

You retain ownership of materials you provide. You grant us permission to use those materials only as reasonably necessary to assess and perform your order, including through authors working on the project.

You must have the rights and permissions needed for us to use your materials as instructed.

We do not accept:

  • Academic work intended to be submitted deceptively as a student's own work.
  • Unlawful content or instructions.
  • Projects that infringe copyright or other third-party rights.

We may accept lawful adult-themed writing, subject to our review and applicable law.

If we discover that a project falls within a prohibited category, we may decline or stop the work and notify you. This does not exclude any refund rights you have under these Terms or applicable law.

8. Our voluntary refund guarantees

These guarantees are additional to your statutory rights.

Consultations

You may cancel and request a full refund of the consultation fee for any reason within three months after payment, including after the consultation has taken place or the report has been delivered.

Writing services

You may cancel a writing project before delivery and receive a full refund of the amounts paid for that project.

After delivery, you may request a full refund for any reason until three months after acceptance. Acceptance may be express or occur after three months without a response, as described in Section 6.

Requesting and receiving a refund

Email contact@tale.guru with enough information to identify your order and state that you want a refund. No explanation is required under these guarantees.

We will issue the refund without undue delay and within 14 days after receiving your request, normally through the original payment method. We do not charge a refund processing fee.

Following a full refund, you must stop using, publishing, distributing or selling the refunded deliverables. To the extent permitted by law, rights transferred by us in those deliverables revert to us. This does not transfer ownership of your original materials to us or permit us to publish your confidential materials.

9. Statutory right of withdrawal

Where applicable consumer law provides a right of withdrawal, you may withdraw from a distance service contract without giving a reason within 14 days after the contract is concluded.

To exercise this right, notify us at contact@tale.guru or at our postal address with a clear statement of your decision before the withdrawal period expires. You may use the model form below, but you do not have to.

If you ask us to begin providing services during the withdrawal period, we will obtain your express request before beginning. If you then withdraw before completion, applicable law may permit a proportionate charge for services already supplied, provided the legal requirements have been met. However, we will not deduct such a charge where our full-refund guarantee under Section 8 applies.

You lose the statutory right of withdrawal for a fully performed paid service only where performance began with your prior express consent and your acknowledgement that the right would be lost once the service was fully performed. Merely accepting these Terms does not constitute that separate consent.

For a consultation, full performance requires both the call and the written report. Expiry of the statutory withdrawal period does not end our longer voluntary refund guarantees.

Model withdrawal form

To: Yury Nikiforov, Tale Guru, 28 Oktovriou 279, 3035 Limassol, Cyprus; contact@tale.guru.

I hereby give notice that I withdraw from my contract for the provision of the following service.

Please include the service ordered, the date of the order, your name, your address and the date of this notice. Add your signature only if submitting the notice on paper.

10. Ownership and use of writing

Once full payment for the relevant writing project has been received, we assign to you the transferable intellectual property rights we hold in the bespoke final text produced for that project, for the full duration of those rights and worldwide.

You may edit, publish, distribute, sell and otherwise commercially exploit that text, including under your own name, without crediting Tale Guru, subject to applicable law.

We will obtain the rights needed from authors we engage to enable this transfer. Moral rights are addressed only to the extent that applicable law permits their waiver or consent to the proposed use.

Third-party materials and your own pre-existing materials are not transferred by this assignment. Any proposed inclusion of third-party material requiring a separate licence will be agreed with you beforehand.

If you approve the use of AI, any rights in AI-generated material transfer only to the extent that such rights exist and can legally be transferred. We cannot promise exclusive copyright protection for material that applicable law does not protect.

We may identify you as a client, name your project or display any part of the work in our portfolio only with your prior written consent.

11. Authors, AI and confidentiality

We may engage third-party authors to provide the services. We remain responsible for their work under your contract and require them to protect confidential project information.

We treat your non-public ideas, instructions, manuscripts and other project materials as confidential. We use and share them only as reasonably necessary to perform your order, with your permission, or where disclosure is required by law.

We will use generative AI for your project only with your prior agreement. We will separately obtain your agreement before submitting your materials to an AI service and explain the proposed use and relevant service.

Information that is already lawfully public, independently developed without using your confidential materials, or lawfully obtained without a confidentiality obligation is not confidential under this section.

Information about personal data processing is available in our Privacy Policy:

[PRIVACY POLICY LINK — TO BE ADDED BEFORE PUBLICATION]

12. Service standards and responsibility

We will provide our services with reasonable care and skill and in accordance with the scope agreed with you.

Creative preferences are subjective. We do not guarantee publication, sales, search rankings, audience response or other commercial outcomes unless expressly agreed in writing. This does not limit our obligation to deliver the agreed services or your refund rights.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

You retain all mandatory rights and remedies available under applicable consumer law.

13. Complaints and disputes

Please send complaints to contact@tale.guru, describing the issue and the order concerned. We will review your complaint and seek to resolve it fairly.

These Terms are governed by the laws of the Republic of Cyprus. If mandatory consumer protection laws in your country of habitual residence apply, this choice of law does not deprive you of their protection.

You may bring proceedings before any court available to you under applicable law. These Terms do not require you to bring a consumer claim exclusively in Cyprus.

14. Changes to these Terms

We may update these Terms for future orders. The version provided or made available to you when your contract is concluded applies to that order unless we agree otherwise in writing.

If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

You can contact us using these details with privacy questions or requests concerning your personal data.

2. Personal data we collect

Depending on how you interact with us, we collect:

  • Contact and enquiry details: your name, email address, optional telephone number, project idea and information you submit through our website or correspondence.
  • Order and project information: consultation arrangements, instructions, agreed scope, correspondence, feedback, manuscripts, reports and deliverables.
  • Billing and transaction information: information needed to issue invoices, identify payments, process refunds and maintain required financial records.
  • Consultation information: information you share during a Zoom call and, only with your prior agreement, an audio or video recording.
  • Website and device information: information such as IP address, browser and device details, pages visited, interactions, referral information and identifiers collected through the website, analytics, advertising technologies and security tools.

We collect information directly from you and through the technologies and service providers described in this Policy.

We do not request sensitive personal data, such as health information or information about your sex life, or personal information about children or other identifiable people for inclusion in projects. Please do not submit such information. Contact us first if a project would require it.

3. Why we use personal data

Under the General Data Protection Regulation, our purposes and legal bases are:

Enquiries, consultations and writing services — contract and pre-contractual steps.
We use your contact details, instructions, correspondence and project information to respond to your requests, arrange consultations, prepare reports, agree and deliver writing projects, provide order updates and handle cancellations or refunds.

Accounting and other mandatory requirements — legal obligation.
We process information necessary to maintain legally required records and respond to binding requests from competent authorities.

Security, administration and legal claims — legitimate interests.
We process information reasonably necessary to protect our website and business from misuse, administer records, investigate complaints and establish, exercise or defend legal claims. We assess these interests against your rights and reasonable expectations.

Consultation recordings — consent.
We record a consultation only with your prior agreement, to support preparation of the consultation report and clarify project instructions. You may decline recording and still receive the consultation.

Optional AI-assisted processing — consent.
We obtain your agreement before using generative AI for your project and separately before submitting your materials to an AI service.

Non-essential analytics and advertising tracking — consent where required by law.
The website uses the tools described in Section 7. Where consent is required, it must be obtained before the relevant technologies are activated. The current status of our consent controls is explained there.

We use email for enquiries, order updates and service communications. We do not use your email address for newsletters, promotional offers or marketing campaigns.

4. Information you need to provide

We need sufficient contact and project information to respond to an enquiry and perform an order. If you do not provide information necessary for a particular service, we may be unable to provide it.

The telephone number and project-idea fields in our initial website form are optional.

Consent to consultation recording or AI processing is separate from agreeing to our Terms of Service or reading this Policy.

5. Service providers and other recipients

We share personal data only where needed for the purposes described in this Policy.

  • Tilda: operates our website, stores website form submissions and provides website statistics and built-in CAPTCHA functionality.
  • Microsoft 365: supports our business email, correspondence and storage of project materials.
  • Zoom: provides consultation calls and stores recordings in its cloud when you have agreed to recording. We do not create automatic consultation transcripts.
  • OpenAI ChatGPT Business: may process project materials only with your prior agreement, as described in Section 6.
  • Google Analytics: provides information about website visits and usage.
  • Meta Pixel: supports measurement of website interactions and advertising-related activity.
  • Authors in the European Union and United States: receive only the project materials needed to complete their work. We do not provide them with your contact details as part of the project handover. Project materials themselves may contain personal data if you include it.

We have agreements governing data processing and confidentiality with the relevant service providers and authors. Providers may also process certain information for their own purposes under their applicable privacy notices.

No payment provider is currently identified for website consultation payments. If we integrate one, we will identify it and make its privacy information available before you pay. We will also explain the payment information made available to us. Its privacy notice supplements this Policy and does not replace our responsibilities for data we control.

We may disclose information where required by law, in response to a valid legal request, or where necessary to establish, exercise or defend legal claims.

We do not sell client contact lists or project materials. The website's use of Meta Pixel is described separately in Section 7.

6. AI-assisted work

We use ChatGPT Business only where agreed with you for the relevant project. Before submitting your materials, we will explain the proposed use and obtain your agreement.

We have not opted in to sharing business data with OpenAI for model training. OpenAI states that ChatGPT Business inputs and outputs are not used to train its models by default.

We limit submitted information to what is needed for the agreed task. You may decline AI processing.

You may withdraw consent to future AI processing by emailing contact@tale.guru. Withdrawal does not affect the lawfulness of processing already carried out. We will explain any effect on the agreed project workflow and address deletion requests in accordance with applicable law and the provider's processing arrangements.

7. Cookies, analytics, advertising and CAPTCHA

Our website uses Tilda Statistics, Google Analytics, Meta Pixel and Tilda's built-in CAPTCHA. Depending on the tool and its configuration, these technologies may process technical information, usage events and device or browser identifiers, using cookies or similar technologies.

We use:

  • Website functionality and security tools to operate the site and protect forms against automated abuse.
  • Tilda Statistics and Google Analytics to understand website usage.
  • Meta Pixel to measure website interactions and advertising-related activity.

As of the date of this Policy, a cookie consent banner has not yet been implemented. We therefore do not represent that visitors are currently offered an on-site choice before non-essential tracking begins.

Where applicable law requires prior consent, non-essential analytics and advertising technologies must remain disabled until valid consent is obtained. Visiting the website, submitting an enquiry or accepting the Terms of Service does not by itself constitute consent to those technologies.

You can manage or delete cookies through your browser settings. Blocking cookies may affect some website functions. Browser settings do not replace any obligation we have to obtain consent.

The precise cookies, storage periods and available consent controls will be documented when the cookie controls are configured.

8. International processing

We operate from Cyprus. Some providers and authors may process information outside the European Economic Area, including in the United States.

Where GDPR restrictions on international transfers apply, the transfer must be supported by a valid mechanism, such as an applicable adequacy decision or appropriate contractual safeguards. A processing or confidentiality agreement alone does not automatically satisfy these requirements.

You may contact us for details of the safeguards applicable to a particular transfer and, where applicable, a copy of them, subject to necessary redactions protecting confidential information.

9. How long we keep information

Our retention periods are:

  • Enquiries that do not result in a paid order: six months from our last communication with you.
  • Client correspondence and project materials: five years after the relevant order is completed or cancelled.
  • Zoom consultation recordings: 90 days after the consultation, unless deleted earlier following a valid request or withdrawal of consent.
  • Accounting and transaction records: for the period required by applicable accounting and tax law.
  • Technical, analytics and advertising data: according to the relevant tool's configuration and provider arrangements. Specific periods will be documented with our cookie controls.

We delete or anonymise information when it is no longer needed. You may request earlier deletion.

We may retain particular information for longer where required by law or where necessary for an existing dispute or legal claim. Any such retention is limited to the information and period needed for that purpose.

Removal from active systems may be followed by deletion from provider recovery areas or backups according to their applicable deletion cycles. Retained recovery copies are not intended for ordinary operational use.

10. How we protect information

We use two-factor authentication and access restrictions for our business systems and project storage.

Access is limited to us, the providers operating the relevant systems and authors who need the relevant project materials. We require appropriate confidentiality protections and limit sharing to what is needed.

No internet transmission or storage system can be guaranteed completely secure. If a personal data breach occurs, we will take the steps required by applicable law, including notifying affected people or the relevant authority where required.

11. Your rights

Subject to applicable legal conditions, you may:

  • Request access to your personal data and a copy of it.
  • Ask us to correct inaccurate or incomplete information.
  • Request deletion.
  • Request restriction of processing.
  • Receive eligible data in a portable format.
  • Object to processing based on legitimate interests.
  • Withdraw consent at any time where processing relies on consent.

Withdrawing consent does not affect the lawfulness of earlier processing.

To exercise your rights, email contact@tale.guru. We may request proportionate information to verify your identity.

We normally respond within one month. If the law permits an extension because a request is complex or numerous, we will explain the extension within that initial period. Requests are normally free of charge, subject to the exceptions allowed by law.

We do not use personal data to make decisions based solely on automated processing that produce legal or similarly significant effects on you.

12. Complaints

Please contact us if you have concerns about our use of your personal data.

You also have the right to complain to a competent supervisory authority, including the authority in the EU or EEA country where you live or work, or where you believe an infringement occurred.

Our local supervisory authority is the Commissioner for Personal Data Protection of the Republic of Cyprus:

https://www.dataprotection.gov.cy

You do not have to contact us before making a complaint.

13. Children

Our services are intended for people aged 18 or over. We do not knowingly collect personal data from children.

If you believe a child has provided personal information to us, please contact contact@tale.guru so we can assess and address the matter.

14. Changes to this Policy

We may update this Policy to reflect changes in our services, providers, processing practices or legal requirements.

The updated version will appear on our website with a revised date. Where required by law, we will provide additional notice or obtain consent before introducing a new use of personal data.
